Please ensure that you have read and understood The ecert Training Company Ltd terms and conditions, before placing your order on this site. By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions.

1. Definitions

In this terms and conditions document unless otherwise stated:

  • “ecert Healthcare Training” means The ecert Training Company Ltd;
  • “Training Course” shall mean the course(s) identified, all related Materials and support, where applicable;
  • “Distance learning” or “paper learning” identifies all materials available for completion off line.
  • “ecert” describes our online training modules and certification
  • “Services” means the support and tuition relating to the chosen ecert Healthcare Training Course, as described on the website;
  • Singular words shall include the plural and vice versa; and headings are included for convenience only and shall not affect the construction or interpretation of these terms and conditions

2. Payments

2.1 We agree to sell and you agree to buy the Online Training Course for the Total Cost/Cash Price and on the terms set out in this document

2.2 The Price is payable prior to the online delivery of the Course by your chosen method either by credit/debit card or PayPal.

2.3 The price payable includes all course study materials, e-certificates

2.4 Under no circumstances shall we be deemed to have received payment until payment has actually been received by us in full.

2.5 We reserve the right from time to time to change the amount of the cost of the course. The current price for any given course will be displayed on the website.

2.6 All prices are subject to VAT as identified by the pricing structure

3. Delivery and Care of the Materials

3.1 We will release all the Materials to you in the online course.

3.2 Course Login Details will be sent by email to the email address you have given us. Please ensure you use the correct email address, to ensure there is no delay with your order.

3.3 You will be deemed to have accepted the Materials if you do not notify us within seven days after delivery

3.4 All training materials, both “Distance Learning” and “ecert” remain the intellectual and commercial property of The ecert Training Company Ltd, any copying, public or private sharing or forward or resale of these training materials is strictly prohibited under the terms and conditions.

4. Warranties and Limitation of Liability

4.1 We warrant that the Materials will be of satisfactory quality but do not warrant that the Materials will be error free.

4.2 We warrant that we will perform any services provided hereunder with reasonable skill and care.

4.3 Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for: (a) losses that were not foreseeable to both parties when this Agreement was made; (b) losses that were not caused by any breach on our part; or (c) business losses and/or losses to non-consumers

4.4 Our liability for direct losses arising out of our negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Agreement shall be limited to the total price paid for the Online Training Course as quoted.

4.5 Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for any indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity or your liabilities to third parties) which you may suffer arising out of or in connection with this Agreement.

5. Other Terms

5.1 No relaxation or indulgence which we may extend to you shall affect our rights under these Terms and Conditions

5.2 If any part of these Terms and Conditions is held to be unenforceable by a Court of Law the remaining terms and conditions shall continue in force

5.3 All liabilities or obligations arising under these Terms and Conditions shall be enforceable against you after termination of this Agreement

5.4 You will notify us immediately, in writing, of any change in the address specified. Any notices required to be served under these Terms and Conditions will be deemed properly served if sent by way of prepaid post to your last known address

5.5 All certificates distribution and marking for distance learning will be stopped and all unlimited ecert access will be suspended if annual payments are not received by the invoiced time and date

6. Cancellation

6.1 You have the right to cancel this contract within 14 days from the day after the receipt of the Materials.

6.2 The right of cancellation will not apply if:

6.2.1 You have accessed any online learning or Materials prior to cancellation. You must not log into the online student portal and/or start your course if you wish to receive a refund.

6.2.2 Any software supplied has been used or the Security seal broken.

6.2.3 You have been provided with any of the Services.

6.3 Notification of cancellation of a course must be made to info@ecerttraining.co.uk
